"The racism and hatred towards homosexuals are the same thing, intolerance towards the other" - Andrea Camilleri
I wanted to start this article explaining in detail what happened last month, Oct. 13, in Parliament. Speaking of the bill "Tanning" against homophobia. How it has been rejected because unconstitutional. The "ruling of unconstitutionality" UDC has been raised.
The law should, in amending Article. 61 of the Criminal Code, introducing the aggravating circumstance of sex discrimination for personal attacks. Instead
go on like this.
Why was this law?
Only in 2008, there were nine murders, 45 assaults, extortion, 7, 5 and 9 episodes of bullying acts of vandalism against individuals and groups gay and lesbian and trans.
In 2009, the situation has worsened to the point that an exponent of the Democratic Party has felt the need to try to change the situation.
I wish the PDL had made such a proposal: he would have been shown to keep their citizens, and even voters. Not all homosexuals are left, even if you like to believe.
The fundamental question is, however, that all those who are discriminated against disabled-, trans-and, in substance, homosexuals feel the need to be protected.
Article 2 of the Italian Constitution: The Republic recognizes and guarantees the inviolable rights of man, as an individual and in social groups where he expresses his personality, and demands the fulfillment of mandatory duties of political solidarity, economic and social development.
If a couple of gay boys or girls walking down the street and is attacked, beaten, those responsible must be punished more severely than normal attack? The answer is yes. First of all, because homophobia is like racism (intolerance that leads to much worse things). If it is not obstacle, it will become normal. It is obviously not the best method, but a small step forward.
[the best way to pass the pedagogy, the intervention in schools, ... arguments for a future article]

It is Article 2 of Paper. What does "The Republic recognizes and guarantees the inviolable rights of man"? From a legal point of view it should be noted, first, recognize the use of the verb, interpreted as evidence that the inviolable rights of man are the existing Constitution, and have a value of "pregiuridico" and universal: the 'law does not create them from scratch (ie from scratch) but simply to acknowledge their existence. Just this value "pregiuridico" allows you to transform the art. 2 in a sort of open clause, stating that Article. 2 leaves the interpreter and the lawyer can determine whether, in the evolution social rights arise from the need to protect and guarantee the people.
To explain in a more simple concept, we can say that Article. 2 is configured as an "open catalog of rights". They are "new rights" and among them there is also the right to sexual identity (among other, equally important, as the "right to life" and "freedom of conscience").
a result, despite not being mentioned in the Constitution these rights (how could the fathers-and mothers-constituents know how it could change society?), They exist and must be accepted as more fundamental. And that is why there is a legislator. For this last October 13, the law had to be approved, saying: "We hold that homophobia is one of the evils of our country, and homosexuals have equal rights of others," should not be labeled as unconstitutional. UDC. Union Center. Vatican. Pope
I leave you to the appropriate conclusions.
emerges from all this a bleak picture. Italy lives in another world.
On October 29, Barack Obama signed the Matthew Shepard Act, the law treats crimes of homophobia than racism. The new version expands the definition of "hate crime", hate crimes, so far considered only for cases of discrimination ethnic, racial and religious, also include those made by the different sexual orientation and disability as well for the victims.
But Italy has been called by the UN High Commissioner for Human Rights, "undermined the law against homophobia was a setback for Italy, for homosexuals is needed for full protection."
I want to end the article, trying to share my sentiments and feelings on everything.
Every time I hear or read a story about an assault or a beating, I remain silent and pray that is the last time you should hear these episodes of violence. Each Once this happens, again, something. Boys disfigured his face, sent to the hospital. Pain. Death.
Because there is indifference to these crimes? It will never die hatred towards the "different"? But hatred for what? We do not choose to be homosexual, it is a fact, like the sun shining in the sky. What could be more natural love between two people, whoever they are? It's just hypocritical for some account of a sexual nature or moralistic?
Parents, say parents, who reject their children, parents tell the child "I want you to die" because of their homosexuality, the death penalty in certain states (with the lowercase on purpose), discrimination at work, risking their safety on the streets. Why not throw in a concentration camp as the Nazis did? 100,000 homosexuals were deported to the camps. Less than 70 years ago. And the hatred remains.
